The information contained on the website regarding the Firm is that in force at the time of its publication, ensuring that it is accurate and precise at all times, proceeding to update it as quickly as possible, trying to avoid errors and correcting them as soon as they may be detected. In any case, APPSEC cannot guarantee that there will be no errors in it or that the content of the information is permanently updated.

APPSEC may make, at any time and without prior notice, modifications, deletions or updates of the information and conditions contained on the website or in its presentation, configuration, access, use, functionalities and specific contents.

Access to the website as well as the use of the information, contents, utilities and services, are the exclusive responsibility of the user.

APPSEC will not be responsible for any damage or harm that may arise from these events, nor can it guarantee that access will not be interrupted or that the content or software that may be accessed will be free of error or damage.

The information provided in response to any query or request for information is merely indicative and/or informative about its activities, products and services, and in no case will it be binding on APPSEC, or on the contracting of the same by customers and users, unless expressly indicated otherwise.

The contents of the website may be downloaded to the user’s terminal provided that it is for private use and without any commercial purpose, but may not be exploited, reproduced, distributed, modified, publicly communicated, transferred or transformed, unless specific and express authorisation.

General Terms and Conditions of Use of the Website

These general conditions regulate access to and use of the website that APPSEC makes available free of charge to its customers and users. Access to it implies its acceptance without reservation. These general conditions will apply to the activities of providing information and, where appropriate, promotional activities that are carried out through the website, so these conditions will govern both access, browsing and use of the website.

Access, browsing or use of any utility or service on the website entails the acquisition by the user of this condition for these purposes.

Access, browsing or use of the website implies without reservation the full acceptance by the user of each and every one of the general conditions of access and use of the website in force at all times when the user accesses it, as well as at the time and where appropriate, of the general conditions of contract that are established for the acquisition of goods or the provision of services.  of the particular conditions that, where appropriate, may govern the acquisition of products or the provision of services and of these. Consequently, if the user does not agree with any of the conditions established herein, he/she must refrain from accessing and using this website and the utilities that may be made available to the user at any time through it or in a related manner.

APPSEC reserves the right to modify at any time these general conditions of use of the website as well as any other general or particular conditions, regulations of use, instructions or notices that may be applicable. Likewise, APPSEC reserves the right to suspend, interrupt or cease operating the website at any time.

The conditions of access and use of this website are governed by the principles of legality and good faith, and the user undertakes to use the website, as well as the information or services provided in accordance with the Law, morality, good customs and public order.

  1. Purpose.

1.1. Through the website, APPSEC provides its users with information about its corporate identity, activities, products and services, as well as access to various contents, data and its own and general information (hereinafter “the contents”) made available to customers and users by APPSEC or, at the time and where appropriate, by third-party content providers. APPSEC reserves the right to modify at any time the presentation, configuration and location of the website, as well as the contents and conditions required to use them.

  1. Conditions of access and use.
  • User requirements. Access to and use of this website is only allowed to adults, so APPSEC is exempt from liability in the event that false or erroneous data have been inserted regarding the user when filling in the form, corresponding in any case to the user or legal representatives. APPSEC reminds users of legal age who are in charge of minors that it will be their sole responsibility to determine which services and/or content are or are not appropriate for the age of the latter. APPSEC informs you that there are computer programs that allow you to filter and block access to certain content and services.
  • Access to and use of the website. The user acknowledges and accepts that access to and use of the website and/or the contents included therein takes place freely and consciously, under their sole responsibility. Access to the website and/or the content included therein does not imply any type of guarantee regarding the suitability of the website and/or the content included for particular or specific purposes of the users. APPSEC may establish limitations and/or additional conditions for the use and/or access to the website and/or the contents, which must be observed by the users in all cases.

The user undertakes to make diligent use, where appropriate, of the access codes to restricted areas of the website and/or related services, being responsible for the security and confidentiality of the same and having the obligation and exclusive responsibility to keep and guard them in a safe place in order to prevent access to unauthorized third parties. The user also undertakes to notify APPSEC, as soon as possible, of any incident that arises or may result in a risk to the confidentiality of the data.

  • Authorised use of the website and contents. The user undertakes to make appropriate and lawful use of the website and its contents, in accordance with applicable legislation, these general conditions of use of the website, generally accepted morality and good customs and public order. The user must refrain from: a) Making unauthorised or fraudulent use of the website and/or its contents; b) Accessing or attempting to access restricted resources or areas of the website, without complying with the conditions required for such access; c) Using the website and/or the contents for purposes or effects that are illicit, illegal, contrary to the provisions of these general conditions, good faith and public order, harmful to the rights and interests of third parties, or that in any way may damage, disable or overload the website, image or business of APPSEC, or to prevent the normal use or enjoyment of the website; d) Cause damage to the physical or logical systems of APPSEC, its suppliers or third parties; e) Introducing or disseminating computer viruses or any other physical or logical systems on the network that are likely to cause damage to the physical or logical systems of APPSEC, its suppliers or third parties; f) Attempt to access, use and/or manipulate the data of APPSEC, third-party providers and other users; g) Reproducing or copying, distributing, allowing public access through any form of public communication, transforming or modifying the contents, unless authorized by the holder of the corresponding rights or legally permitted; h) Deleting, hiding or manipulating the legends and information on intellectual or industrial property rights and other identifying data of the rights of APPSEC or third parties incorporated into the contents, as well as the technical protection devices or any information mechanisms that may be inserted in the contents; i) Obtaining and attempting to obtain the content using means or procedures other than those that, depending on the case, have been made available for this purpose or have been expressly indicated on the website where the content is located or, in general, those that are usually used on the Internet as they do not entail a risk of damage or disabling of the website and/or the contents.

The establishment of the link does not imply in any case the existence of any relationship between APPSEC and the owner and/or operator of the website on which it is established, nor the knowledge, acceptance and/or approval by APPSEC of its contents and/or services. APPSEC will in no case be liable for the consequences that may arise from the introduction of links by third parties, or from the contents, information and/or services offered on the websites on which the link has been established.

The website includes links to third-party websites that are considered to be of interest to users. APPSEC does not assume any liability arising from the connections or the contents of these links.

The user undertakes to comply with these general conditions with any modifications that they may undergo in the future and that will be published immediately on the website and inserted in this section, as well as the specific conditions that may be applicable. They are also obliged to comply with the special warnings or instructions for use contained therein or on the website, and to always act in good faith and in accordance with the Law, morality and good customs, employing the diligence appropriate to the nature of the service they enjoy, refraining from using the website, utilities or contents in a way that may impede,  hinder, damage or deteriorate the normal functioning of the same, the image, goods or rights of APPSEC, customers, suppliers or third parties.

The user undertakes not to carry out advertising, promotional or commercial exploitation activities through or using the website and its contents, as well as not to use its contents or utilities and especially the information obtained from it to send advertising, send messages for direct sales purposes or for any other commercial purpose.  or to collect or store personal data of third parties.

For these purposes and for any communication that may be necessary between APPSEC and the user, requests, questions, suggestions or complaints, the latter may contact the User Service (SAU) by email to the following address support@appsec.es or by written communication addressed to the following postal address: Nicolas Copérnico 8, 21, 46980 Parque Tecnológico, Paterna,  Valencia. Communications from APPSEC to the user will be made at the postal or electronic addresses provided by the user when registering. The user expressly accepts e-mail as a valid means and channel of notification for the practice of any communication related to the website, its use, utilities, contents and/or the acquisition of goods or services.

  1. Industrial and intellectual property rights.

The website, programs and content are protected by Spanish and EU intellectual and industrial property laws and international treaties. All intellectual property rights in the application and associated tools are reserved. The user acknowledges and accepts that all industrial and intellectual property rights over the contents and/or any other elements included in the website (including, without limitation, trademarks, logos, trade names, other distinctive signs, texts, images, graphics, icons, photographs, designs, sounds, databases, software, flow charts, presentation, programming elements, web design,  audio and video), belong to APPSEC, its suppliers and/or third party owners of the same who have authorised their inclusion on the website. Under no circumstances does access to the website imply any type of waiver, transmission, licence or total or partial transfer of said rights or expectation of right, unless expressly stated otherwise. These general terms and conditions of use of the website do not confer on users any other right to use, alter, exploit, reproduce, distribute or publicly communicate the website and/or its contents other than those expressly provided for herein. Any other use or exploitation of any rights will be subject to the prior and express authorisation specifically granted for this purpose by APPSEC or the third party owner of the affected rights.

APPSEC authorises users to use, view, print, partially download and store the contents and/or elements inserted in the website as long as it is compatible with the purposes of the website, which is carried out with the exclusive purpose of obtaining the information contained for personal and private use – it is expressly prohibited, among other things,  its use for commercial purposes, especially for its distribution, public communication, transformation or decompilation, as well as for the performance of any practice or act of imitation or unfair competition-, that its integrity is maintained and that it is not modified or transformed -it is expressly prohibited, among other things, that the graphics, distinctive signs, icons or images available on the website are used,  copied or distributed separately from the text or other images that accompany it-, and, in any case, provided that the origin and/or author of the same is indicated and, where appropriate, that the copyright symbol and/or industrial property notices of their owners appear. The use of such elements, their reproduction, communication and/or distribution for commercial or lucrative purposes, as well as their modification, alteration, or decompilation, is strictly prohibited. For any other use other than those expressly permitted, it will be necessary to obtain the prior written consent of the owner of the rights in question.

APPSEC is the owner of the industrial property rights referring to its trademarks, products and services. APPSEC ® are registered trademarks owned by the Firm.Regarding the citations of products and services of third parties, APPSEC recognizes in favor of their owners the corresponding industrial and intellectual property rights, their mere mention or appearance on the website does not imply the existence of any rights or responsibility of APPSEC over them, nor does it imply endorsement,  sponsorship or recommendation by APPSEC, unless expressly stated.

The unauthorised use of the information contained on the website, its resale, as well as the infringement of APPSEC’s intellectual or industrial property rights or its image in the market will entail the demand for legal responsibilities before the competent national or international bodies and courts.

  1. Use of cookies.

APPSEC reserves the right to use the so-called “cookies” or similar files, in any type of use of the website. The user agrees that APPSEC or its service providers may use cookies when a user browses the website. The User may configure their browser to notify and reject the installation of cookies  sent by them, without this affecting the User’s ability to access content that does not require identification.

  1. Security.

APPSEC, aware of the risks arising from facing the new challenges posed by the provision of services or the use of applications or communication tools through communication networks, especially the Internet, has had demanding security measures in place to reduce these risks. However, APPSEC cannot guarantee the absolute invulnerability of its security systems, so it excludes any type of liability for damages of any nature and class that may be due to the presence of viruses or other elements that may cause alterations in the computer system (software and hardware), terminals, electronic documents and files of the user or any third party.  specifically including those that occur in the services provided by third parties through the application.

The user is informed that the use of electronic systems for data transmission, e-mail and sending messages to mobile phones through technological platforms does not offer absolute guarantees of security. APPSEC and the user mutually exonerate each other from any liability arising from events such as non-receipt or delay thereof, error or interception of communications.

Access to the application and associated tools, as well as the non-consensual use that may be made of the information and contents thereof, is the sole responsibility of the person who does so. APPSEC will not be liable for any consequence, damage or harm that may arise from such access or use.

  1. Disclaimer of Warranties and Liability.

Exclusion of guarantees and liability for the operation of the website and information services requested. APPSEC does not guarantee the availability and continuity of the operation of the website or those other websites to which a link has been established. Likewise, APPSEC will not be liable in any case for any damages that may arise, including but not limited to a) The lack of availability or accessibility to the website or to those other sites to which a link has been established  ; b) The interruption in the operation of the website or computer failures, telephone breakdowns, disconnections, delays or blockages caused by deficiencies or overloads in the telephone lines, in the Internet system or in other electronic systems produced in the course of its operation; c) The lack of suitability of the website for the specific needs of users; d) Other damages that may be caused by third parties through unauthorized inferences or interferences beyond the control of APPSEC; e) The impossibility of providing the service or allowing access and use for reasons not attributable to APPSEC, due to the user, third parties, or force majeure and; f) The lack of permanent updating of its contents and the divergences of the information, documentation and contents of the website, its appearance, graphic representation and visualization with the printed version.

In order to reduce the risk of viruses being introduced into the web, APPSEC uses virus detection programs to monitor all the content it introduces into the web. However, APPSEC does not guarantee the absence of viruses or other elements on the website introduced by third parties unrelated to APPSEC that may cause alterations in the physical or logical systems of users or in the electronic documents and files stored in their systems. Consequently, APPSEC will not be liable under any circumstances for any damages of any kind that may arise from the presence of viruses or other elements that may cause alterations in the physical or logical systems, electronic documents or files of the users.

APPSEC adopts various protection measures to protect the website and content against computer attacks by third parties. However, APPSEC does not guarantee that unauthorised third parties may not have access to the type of use of the website made by the user or the conditions, characteristics and circumstances in which such use is made. Consequently, APPSEC will not be liable in any case for any damages that may arise from such unauthorized access.

APPSEC is not responsible for failures that occur in communications and networks, and does not guarantee the availability and continuity of the operation of the application, associated tools and services, therefore APPSEC does not guarantee the absence of interruptions or errors in access to the application, associated tools, its utilities or its content.  nor that all this is permanently updated. APPSEC will carry out, provided that they are within its competence and there are no causes that make it impossible or difficult to execute, and as soon as it becomes aware of the errors, disconnections or lack of updating, all those tasks aimed at correcting the errors, re-establishing communication and updating the tool.

Exclusion of guarantees and liability for the use of the website, applications and/or related services. APPSEC does not control, in general, the use that users make of the website and applications. APPSEC does not guarantee and will not be responsible in any case for the use that users and/or third parties may make of the website, its contents, applications or related services, nor for any damages that may arise from it.

Exclusion of guarantees and liability for content. APPSEC does not edit the content of third parties published on the website, consequently, it does not guarantee nor is it responsible for the legality, reliability, usefulness, veracity, accuracy, exhaustiveness and timeliness of said content. APPSEC will not be liable in any case for any damages that may arise from a) The lack of legality, reliability, usefulness, veracity, accuracy, completeness, and/or timeliness of the content originated by third parties; b) The inadequacy for any purpose and the disappointment of the expectations generated by the contents; c) Decisions or actions taken or avoided by the user relying on the information or data provided or provided in the contents, including without limitation the loss of profits or business opportunities.

In the event that it deems it appropriate or is required to do so by judicial or administrative order, APPSEC will remove the links to those web pages that infringe the applicable legislation and/or infringe the rights of third parties.

APPSEC declines any responsibility for damages of any nature and kind that may arise from the lack of availability or uninterrupted continuity of the operation of the service due to causes beyond its control, from the loss of the expected benefit or utility that APPSEC or its users may have attributed to the utilities or services,  or the fallibility of all this.

  1. Actions in case of non-compliance.

APPSEC reserves the right to exercise any actions that may assist it in accordance with the law in force and applicable at all times and in any case to demand the responsibilities arising from the breach of any of the provisions of these general conditions of use of the website and/or related services by a user.

  1. Integrity.

The declaration of any of these general conditions of access and use as null, invalid or ineffective shall not affect the validity or effectiveness of the remaining ones, which shall remain binding between the parties. The waiver by either party to require compliance with any of the general conditions stipulated herein at a given time shall not imply a general waiver of compliance with any other condition or conditions, nor shall it create an acquired right for the other party.

  1. Applicable law and competent jurisdiction.

These general conditions of access and use of the website will be governed and interpreted in accordance with the Laws of Spain. For the resolution of any controversy that may arise from access to and use of the website, the user and the Firm expressly submit, expressly waiving any other jurisdiction that may correspond to them, to the Courts and Tribunals of the city of Valencia.
